Swimming Lesson Terms & Conditions

By registering for a UKIYO SWIM SCHOOL class, lesson, secure my time-slot, you confirm and agree to the Terms and Conditions set by Anthony Schulz Learn to Swim the Aussie Way, NIP: 1132945175, trading as ‘UKIYO SWIM SCHOOL’.

Teaching Policies, Procedures and Parental Responsibilities

  • Swimming Teachers will take responsibility for students during their swimming lessons, but parents/guardians are required to remain nearby (poolside viewing or designated viewing area) so that if required the parent/guardian can deal with toilet breaks or any behavioural issues. UKIYO staff will NOT take pupils to the toilet.  

  • Parents/guardians must remain on the premises whilst the student is attending their swimming lessons. This is imperative in case of the unlikely event of a medical emergency, building evacuation or other emergencies. Students must be collected promptly at the end of the lesson. 

  • Lessons start on the agreed time slot that is reserved on the booking platform. Student/parents are advised to arrive on poolside 5 minutes before their lesson.

  • Students in a group lesson can be refused entry to the lesson if they are more than 5 minutes late for a class, as it disrupts the lesson for the other pupils. 

  • If a student/parent arrives late to their private lesson, the student/parent may request the time to be extended only if by extending the lesson there is no conflict with another time-slot. The student/parent accepts and understands by extending the lesson time, a late arrival fee will be charged that is equal to the extended time given.

  • UKIYO Swim School is not obligated to run over the original time-slot agreement.

 

Swimming Lesson Dress Code & Hygiene

  • All children should wear appropriate fitting costumes/trunks specifically designed for swimming. Baggy costumes/trunks can hamper movement.

  • No jewellery should be worn during a swimming lesson. Religious or medical bracelets are allowed but should not distract the swimmer from their lesson.  

  • The use of goggles is permitted but students may be asked to remove them when performing certain skills (unless there is a medical reason for goggles to be worn).

  • All students should shower before their lesson. Please ensure that all hair gel/body lotions etc. are removed. This will help to keep the water clean. Make sure your child uses the toilet before the lesson commences. Please ensure your child showers after the lesson.

Student Progression

  • All students work towards the "UKIYO Swim School development programme”.

  • Swimming Teachers continually assess all students progression throughout each month.  

  • Progression of all students will be at the judgment of the swimming teacher supervisor and in accordance with the progression within the criteria of the "UKIYO Swim School development programme"  

  • Students will be moved up to the next class when they meet the skills criteria required and if there is adequate room in the next level for movement to the next level.  

  • Upon completion of a level, the parent/guardian will be contacted explaining that the child is ready to move up to the next level.  

  • Due to the continuous progressive nature of our programme, and the variety of ability levels within each session, we cannot guarantee a specific time slot on progression, as space within the next stage may not always be immediately available.  

Video and Picture Consent

  • UKIYO Swim School may use a mobile phone or other video recording devices to assist students in understanding their technique.

  • UKIYO Swim School may ask to use a video or picture on social media platforms. 

  • UKIYO Swim School will always forward the student/parent a consent form before adding any video or pictures to UKIYO Swim School social media platforms and or webpage.

  • Upon student/parental agreement UKIYO Swim School has the rights to use a video or picture on social media associated only with UKIYO Swim School.

  • Student/parents have the right to request at any time for a picture relating to them specifically to be removed and deleted from UKIYO Swim School database permanently. UKIYO Swim School will always abide by student/parental requests of removing/deleting a video or pictures relating to them specifically. 

 

 

Lesson description & Family discount

  • Each private lesson has a maximum of 2 students per lesson.

  • Student/parents who wish to have a 3rd student attend a private lesson are required to purchase a discounted 3rd student private lesson fee.

  • Group lessons have a minimum number of students per level and per duration of group lessons. UKIYO Swim School reserves the rights to join students into another group if numbers have not been met and or cancel the group time-slot before the month begins.

  • Families with 3 or more family members signed up to UKIYO Swim School will receive a discount on the 3rd family member.

  • Private lessons that are not associated with a package are valid only within the calendar month that the lesson is purchased in and are not available to be transferred to a new month.

Swimming Lesson Payment

  • All fees for swimming lessons must be paid in advance of the lessons.

  • Payments are taken before the 1st of each month for clients with a secured time-slot and or are attending group lessons.

  • If payment is not received in full before the 1st lesson, UKIYO Swim School reserves the right to cancel the lesson/s.

  • New group joiners, will pay a pro-rata payment for any lessons which take place prior to the first payment taken. 

  • Payment is accepted as Cash (in an envelope with full name), Bank transfer, via Vcita booking platform, Blik, Revolut or the webpage (www.ukiyoswimschool.com.pl), PayPal.

  • If an invoice is required, the student/parent must express this at the time of payment.

  • Student/parents who want to secure a day and time-slot specifically for them, regardless of the duration of the lesson, are required to purchase a once a month monthly fee* that is called "Secure my time-slot".

  • A "secure my time-slot" is a verbal/written agreement between UKIYO Swim School and the student/parent to have a specific day and time-slot (depending upon if the requested day/time-slot are available to be secured, if not available, an alternative day/time-slot will be offered) to be 100% guaranteed every month for the student/parent to secure dates for private swimming lessons on the students/parents secure day/time-slot.

  • During the last week of a month, secure my time-slot students/parents are required to purchase the number of private lessons they wish to have in the next month, upon checkout they must also place the dates they wish to secure.

    • 60zł per month, 1 secure time-slot per week, The plan runs consecutively, regardless of breaks/school holidays/public holidays and or pool closures.

    • 80zł per month, 2 or more secure time-slots per week, The plan runs consecutively, regardless of breaks/school holidays/public holidays and or pool closures.

  • To cancel a Secure my time-slot UKIYO Swim School accepts a minimum of 1 week in advance in writing (via email/mobile text +48 512 517 013) before the end of the month.

  • When a secure my time-slot plan is cancelled it is accepted that the time-slot will now be offered to other students/parents.

  • UKIYO Swim School reserves the right to give priority to students/parents who have requested a non-secured time-slot to be secured for them.

  • The group lesson students have two options; 

    • Pro-rata - i.e. some months there will be five lessons, while most months there will be four. All lessons will be available to attend unless a lesson has been cancelled before the start of the month and therefore won't be available.

    • One-off reservation online after a group has been confirmed for the month.

  • All group lessons must be paid in advance and in full, students will be removed from a group once advance payment no longer continues.

  • During School holidays UKIYO Swim School may run an intensive swim programme of 5 lessons in 5 days. Generally, the intensive programme will start in the morning before the pool becomes busy.

  • Student/parent are responsible to pay the entry/exit fee to the pool. For Wodny Park entry fee rates go to their webpage www.wodnypark.com.pl. Pr1me gym charges a one-off entry fee of 30zł per student. Parents who wish to use the pool, the normal entrance fee to the club is 80PLN. For UKIYO parents 60PLN per visit or parents can take a package of 4 entrance costs 200PLN, please contact Pr1me for further details. Entry to Pr1me is pool and spa area is unlimited.

  • Package of lessons bought via the webpage are valid for 4 weeks. All packages are valid from date of purchase. A new package is required to be purchased upon completing the package and or if the package has expired, whichever comes first.

  • For any failed payments of lessons, UKIYO Swim School reserves the right to restrict access to the lessons until a suitable payment has been made for the missed payment. Under these circumstances, UKIYO Swim School can not guarantee the same time-slot on either a secure my time-slot plan or private lesson or group spot.

  • UKIYO Swim School reserves the right to change the price of swimming lessons at any time. Students/parents will be notified in writing via email with at least 14 working days' notice of any change.

  • Students/parents must notify UKIYO SWIM SCHOOL in writing via email of any non-acceptance towards price changes within 14 days. 

  • If there is no notice of non-acceptance, students/parents will be subject to the updated Terms & Conditions. 

  • Refusing to accept the changes in price will result in the termination with UKIYO SWIM SCHOOL.  

Changing lesson time-slot and Moving Lesson

  • Students/parents may request a change of day/time-slot or Swimming Teacher and we will try to accommodate your request, provided space is available and or the requested time-slot.

  • Swimming ability and speed of progression will vary depending upon the swimmer.

  • In the event of a pool closure, we will make every attempt to contact our students/parents as soon as possible.  

  • Customers paying for swimming lessons will be provided with a catch-up lesson to replace the unforeseen missed lesson.

  • In the event of a planned pool closure, the student/parent will be offered an alternative day/class or credit to the next booking.

  • Ukiyo Swim School reserves the right to cancel classes should number of students fall below our minimum numbers per group. If this happens the class may be cancelled or the student/parent will be offered an alternative lesson of the same level. 

 

Missed Lessons

  • Lesson fees are non-refundable where the student has either missed private/group lessons or decided to withdraw from the programme altogether. 

  • Group Lessons run consecutively; the group lesson fee will be utilised as each lesson takes place regardless of pupil attendance (with the exception of pool closure/lesson cancellation).

  • Secure my time-slot & or private lesson student/parents may reschedule a secured time-slot 24 hours prior to the lesson to any available time-slots online in the same month. UKIYO Swim School takes no responsibility to secure another time-slot for a rescheduled private lesson.

  • In certain circumstances, UKIYO Swim School may exercise discretion on partial refunds or partial credit for a missed lesson and in exceptional circumstances, a refund or credit may be given only by producing a medical certificate or documentation from a medical centre, hospital or GP.

Changing Teacher

  • We will use reasonable endeavours to provide the same instructor for each lesson within a course. However, relief instructors may be used without prior notification. 

  • We reserve the right to appoint a new teacher at any time and may, at times need to provide an alternative teacher for a class or classes due to illness or for any other unforeseen circumstances.  

  • In the event a teacher is away for a long period of time we will try to keep the same cover teacher for the time period where possible.  

  • If a teacher is absent, UKIYO Swim School reserves the right to join classes together if considered appropriate. We would always try to put a replacement teacher in place immediately however, if this is not manageable, we would put the classes together in order to avoid the cancellation. This would be an extremely rare occurrence as additional teachers are usually available to cover any such eventualities.  

 

Communication

  • Questions regarding the progression of students should be directed towards Anthony Schulz via enquiry@ukiyoswimschool.com.pl  

  • All Students/parents/guardians are required to supply UKIYO Swim School with a valid e-mail address/mobile number for quick communication purposes. This is essential so that we can inform you when your child is ready to move up a level of lessons and or to inform you of any changes to the programme.

  • Students/parents/guardians have the right to request any information obtained by UKIYO Swim School to be deleted.

 

Viewing

  • Parents/guardians are not permitted on poolside at Wodny Park but must sit either on the seats next to the 50m pool or behind the glass next to reception. In coming to Wodny Park Parents/guardians understand it is a drop-off and pick up only.

  • Where pool viewing is on poolside (Pr1me), parents must not interfere with the lessons or distract the swimming teachers.  

  • We do ask that all spectators remain in the seating area in order to prevent any unnecessary distractions for the teachers and make every effort to ensure that all parents/guardians abide by the pool dress rules. 

  • It is difficult for the teaching staff to gain full attention from their pupils if they are being distracted; progress can be affected if children are not fully able to concentrate.  

  • No photography or filming is permitted on poolside or in the changing area without the prior approval from the Centre Management that the lessons are being conducted at.

 

Behaviour & conduct

  • Parents accept that their child is under the supervision, control and care of the Swimming Teacher, during the lesson period. Should the behaviour of the child be unsatisfactory and the class is being disrupted, the Swimming Teacher has the right to remove the pupil from the class.  

  • The teacher may employ reasonable measures as are necessary to maintain the smooth delivery of the class. We reserve the right to request that your child should be removed from classes should they persistently disrupt or are seen to be putting themselves or anyone else at risk during the class. If a child is removed under these circumstances and suitable alternatives arrangements cannot be made, no refund will be provided.

  • Once a lesson has finished, if the child wishes to spend extra time in the pool then an adult must be in the water at all times with the child. If the parent is not swimming, the child must leave the pool area once their lesson has finished. 

  • If a swim student causes the cancellation of a swim school session or individual class, we reserve the right to apply a penalty for loss of income for this activity. This will be administered and applied by UKIYO Swim School administration.

 

Changes to Terms & Conditions 

  • UKIYO SWIM SCHOOL reserves the right to update Terms & Conditions by sending students/parents the new versions. 

  • Students/parents must notify UKIYO SWIM SCHOOL in writing via email of any non-acceptance within 14 days of the new Terms & Conditions. 

  • If there is no notice of non-acceptance, students/parents will be subject to the updated Terms & Conditions. 

  • Refusing to accept the Terms & Conditions will result in the termination with UKIYO SWIM SCHOOL.
